Lewiston airport has been taken over by the City of Lewiston, many airport users and local residents are unhappy about the process and so now Nez Perce County Commissioners and prosecutors are going to meet in mediation to try and resolve the issues.
The airport is jointly owned by the city and the county and there is a hope that open and frank discussions which mediation allows will pave the way to the two sides reaching an amicable solution.
From the skies above to the waters below mediation can assist, our next report is from Fox Galvin law firm in St. Louis specifically an article from partner Ron Fox who has been a mediator and litigator in the industry for many years.
Fox reminds us of the benefits of mediation, it’s confidential, can have wider resolution powers than a court, it’s cheaper and quicker, why would you litigate when you can mediate?
“A major incentive to settle a case is to avoid the risk and uncertainty of trial. Settlement eliminates these uncertainties. A good mediator helps the parties understand they can either take control of a case by settling, or they can face the risk of trial over which they have little or no control. Having control is frequently better than rolling the dice.”
And back to the skies above (or a higher power). His Holiness Pope Francis has said the Vatican is prepared to step in to assist Venezuela in it’s hour of need and to mediate a resolution in the recent disputed elections.
Nicolas Maduro is no longer recognised by the US and much of the West as a legitimate ruler of the country Juan Guaidò declared himself interim president following Maduro’s election for a second term.
Maduro’s right to govern is primarily called in to doubt because, it is alleged, the government imprisoned and deported most of the opposition party leaders leaving him as a safe bet to win the election pretty much unopposed.
As a result of the civil unrest Maduro has written to the Pope who in acknowledging the Vatican’s ability and willingness to assist has also said that small diplomatic steps towards an open dialogue need to happen first.
The Vatican has previously been involved in South American mediaitons notably when Pope John Paul II helped to avoid war braking out between Argentina and Chile.
Taking a neutral tone the Pope publicly said “I support in this moment all of the Venezuelan people - it is a people that is suffering - including those who are one side and the other. All of the people are suffering,”
The bishops in Venezuela are clearer in their view of the election Archbishop Emeritus of Caracas Jorge Liberato Urosa Savino called the election “illegitimate” and added “I hope Maduro, who always appeals to the pope's words, heeds those calls, and steps down from office since his administration has been absolutely harmful for the Venezuelan people.”
Down from powers on high but staying the airs above us the National Mediation Board (NMB) has been asked to mediate contractual disputes revolving around pay and conditions for the International Brotherhood of Teamsters and United Airlines, a catchy union name if ever there was one.
Captain David Bourne Division Director for Teamsters said “We're confident that all of us can work together to craft a collective bargaining agreement that reflects the value, expertise and professionalism that these workers bring to United Airlines.”
There are so many cases which could have been resolved by early intervention of mediation it continues to surprise me the lengths the public (and some lawyers) will go to avoid referral.
