Tax return time! It’s not been a bad year so the figures look pretty good, I would say sadly I have to pay the tax now but not at all, it’s good to pay tax, everyone should, I’m working with a different hat on with clients desperate to avoid CGT in the upcoming budget but we don’t know the changes yet and there are multiple ways of reducing your exposure that are simply keeping good records (I make this comment as much to myself as to remind clients in mediation that you only pay a percentage of the gain and there are often expenses to be taken off the headline figure before the percentage is applied).
Delaying tends to make things worse, in law delay defeats justice in mediation specifically delay causes stress and cost and if it comes before mediation even begins can end up destroying any faith clients have in the process. I recently worked with a couple of clients who first contacted me on Monday and by Friday we had an agreement in place, we can move that quickly if everyone wants to, it’s not always possible but sometimes leaving the tea to stew is the worst move.
It’s not necessarily good move that mediation is on the increase, in terms of cases at a national level it is great to see the embracing of mediation but sadly on the world scale such is the state of war in many areas the numbers of mediator countries is going from the usual suspects to a significantly larger handful of options.

The three pillars of mediation remain it’s voluntary (at the moment), it’s confidential, the mediator is impartial and independent, by using those pillars to support your work the parties keep control, save costs, save time and energy and reduce stress.
In person or via electronic media as we’ve said before choose to mediate early and resolve your issues effectively, timeously, and with less stress and costs than going to your solicitor so you can get out choose a different path, not quite the road less travelled but perhaps the path less adversarial. You have an interest in the outcome the sooner you get round the mediation table the quicker you can move forward and avoid the grilling a cross examination in court would put you through.
By having a deep and meaningful discussions with parties the mediator elicits what the true “red-lines” are and where there is the potential for compromise, it is with this structured period of reflection that the parties are then able to reach an accord.
The flexible nature of mediation and the possible outcomes make it an ideal way to resolve disputes in an ever-changing world and the open nature of discussions in mediation whilst remaining confidential allows all sides to engage fully in the process and understand the needs of all involved allowing parties to reach a conclusion which both sides can live with and move on.
There are so many situations which could have been resolved by early intervention of mediation it continues to surprise me the lengths the public will go to avoid referral.
